Welcome to Eplayment. These Terms and Conditions (“T&Cs”) cover your rights and obligations relating to your access and use of the products and services of Eplayment: the Eplayment Wallet, Epaygames Payment Gateway, Eplayment Website, PIXEL by Eplayment, and all the services associated with it (together, “Eplayment Service”). All references to “we”, “us”, “our”, or “Eplayment” refer to Eplayment Corporation, a corporation organized under the laws of the Philippines. We are duly registered with and licensed by the Bangko Sentral ng Pilipinas (“BSP”). By accessing or using the Eplayment Service, you accept and agree to be bound by these T&Cs.
In addition to these T&Cs, please review our Privacy Notice and Acceptable Use Policy. The Privacy Notice describes how your personal data is collected and processed when you use the Eplayment Service. The Acceptable Use Policy defines the set of rules that you must comply with as you use the Eplayment Service. If you do not understand or do not wish to be bound by the T&Cs, Privacy Notice, and Acceptable Use Policy, you must not access or use any portion of the Eplayment Service.
Read these terms carefully, as they contain important information about your rights and responsibilities. These T&Cs shall be valid and binding from the time of your use of the Eplayment Service, and will remain binding up to its termination by us, except for provisions that will remain effective after termination, as stated in these T&Cs, laws, or regulations.
1.1. By registering for an Eplayment Account and accepting these T&Cs, you represent that you are 18 years old, and warrant that you possess legal capacity to agree to these T&Cs. If we learn or have reason to suspect that any user is under 18 years of age, we will promptly revoke the user’s access to the Eplayment Service and delete any personally identifiable information submitted by that user. Eplayment assumes no liability arising from any misrepresentation effected during the registration process.
1.2. Further, you represent and warrant that your use of the Eplayment Service does not and will not conflict with any pre-existing obligation in conflict or in any way inconsistent with the provisions in these T&Cs.
1.3. If you are a business entity, you represent that you are licensed to do business and that the persons including your employees, officers, representatives, and other agents accessing or using the Eplayment Service are duly authorized to access or use the Eplayment Service. All transactions conducted under your login credentials are deemed for your account.
Definitions appearing in these T&Cs shall have the meanings ascribed to them below.
“Acquirer” shall refer to a financial institution that is authorized by a Payment Method Provider to integrate with their payment API, which allows the Acquirer to process transactions made by customers holding an account with the Payment Method Provider.
“Application Programming Interface” or “API” shall refer to a type of software interface service offered to other pieces of software.
“Biller” shall refer to an entity that has authorized a financial institution to accept bills payments from their customers on their behalf. “Cash In” or “Add Funds” shall refer to the addition of money to your Eplayment Account through other Eplayment Accounts or Payment Methods.
“Cash Out” shall refer to the withdrawal of money from your Eplayment Account through ATM or Online Transfer. This function is only available for Verified Accounts.
“Chargeback” shall refer to a return of money to a customer who has paid a transaction. The chargeback reverses a money transfer from the customer's bank account, e-wallet, credit card, or other available Payment Methods in the Eplayment Service.
“Netbank” refers to the white-labeled bank based in the Philippines, Netbank. Eplayment is partnered with Netbank in banking services, including but not limited to the verification, management, and protection of Verified Accounts.
“Epaygames Merchant” shall refer to a business running a website or application that uses the Epaygames Payment Gateway to process payments.
“Epaygames Payment Gateway” shall refer to Eplayment’s payment gateway service that includes software and API integration to allow real-time secure data transmission for processing debit cards, credit cards, e-wallets, and other available Payment Methods.
“Eplayment Account” shall refer to a financial account assigned to a registered user of the Eplayment Wallet. This account is linked to the user’s Mobile Identity Number (“MIN”).
“Eplayment Partner Outlet” shall refer to a Payment Method Provider’s establishment that supports Eplayment Cash In or Add Funds transactions.
“Eplayment Tokens” are earned digital assets with conversion value that are collected and earned by verified users by performing various activities and transactions using the Eplayment app. Verified users can use the converted Tokens to redeem gifts and rewards.
“Eplayment Wallet” shall refer to the electronic money instrument that stores Philippine Peso (“PHP”) value which resides in the Eplayment application system and runs on web and mobile devices.
“Eplayment Website” shall refer to the official website (eplayment.co) maintained by Eplayment.
“Fund Transfer” shall refer to a transfer of money between any qualified bank or e-wallet account, and an Eplayment Wallet with a Verified Account.
“Know-Your-Customer” or “KYC” shall refer to the process of verifying the identity of a customer, as mandated by the BSP. KYC shall be mandatory for Verified Accounts. The process shall be performed by Eplayment, ZOLOZ and Netbank.
“Load Provider” shall refer to an entity that has authorized a financial institution to resell their game, entertainment, and mobile network load and vouchers.
“Mobile Personal Identification Number” or “MPIN” shall refer to the six-digit security personal identification number of and nominated by the user who has registered for the Eplayment Account, that they may use to access their Eplayment Account.
“Payment Method” shall refer to the payment methods such as debit cards, credit card, e-wallets, and over-the-counter channels that are made available and processed real-time through the Epaygames Payment Gateway.
“Payment Method Provider” shall refer to the financial institution authorizing Eplayment to accept transactions on their behalf via the Epaygames Payment Gateway.
“Peer-to-Peer Transfer” or “P2P Transfer” shall refer to the transfer of money from an Eplayment Account to another Eplayment Account. Eplayment Accounts that have not been verified may not send money to Verified Accounts.
“Point-of-sale” or “POS” shall refer to a place, online or offline, where a customer executes the payment for goods or services and where sales taxes may become payable.
“P2P Transfer QR” shall refer to a specific QR code which processes P2P Transfer as it is scanned. Users may generate, scan, or upload a P2P Transfer QR to send or receive money using their Eplayment Account.
“Settlement” refers to the amount due to the Epaygames Merchant from their transactions minus our fees and any fines, refunds, chargebacks, reversals, setoffs, recoupments or any other amounts due to Eplayment;
“Short Message Service” or “SMS” shall refer to a telecommunications protocol that allows the interchange of short text messages between mobile devices.
“Verified Account” shall refer to Verified Eplayment Accounts, each of which are linked to a Netbank savings account.
3.1. Upon registration and acceptance of these T&Cs, you will set up your Eplayment Account that is associated with a registered mobile number (“Mobile Identity Number”, or “MIN"). Depending on the particular Eplayment Service that you will be using, you will be required to provide additional information, such as your complete name, present and/or permanent address, date of birth, nationality, place of birth, gender, civil status, mother’s maiden name, source of funds, employment status, employer or business name, nature of work, proof of identification, photo of yourself, and signature, in compliance with the Know-Your-Customer (KYC) requirements of the BSP. In some cases, we may ask you to provide additional information that can aid in verifying your identity.
3.2. A verification of your submitted information through a third-party verification partner may be undertaken. Any such third-party to whom we disclose or transfer your information for the purpose of verification shall be contractually bound to comply with confidentiality standards, establish adequate safeguards for data privacy, undertake to respect any user’s right to privacy, and comply with applicable laws and regulations relating to data processing. We also require that said third parties use information shared with them only for relevant purposes and follow our reasonable directions with respect to this information.
3.3. You agree to submit all required information or documentation and render all reasonable assistance and cooperation in order to complete the verification. Such information will be used to determine if you can continue to use your Eplayment Account or the Eplayment Service. We reserve the right to close, suspend, or limit your access to your Eplayment Account and/or the Eplayment Service in the event that we are unable to verify your information.
3.4. You are responsible for providing accurate and truthful information during registration and verification, keeping your account information up to date, and notifying us in the event of changes, including but not limited to the nature of your business activities, beneficial owners, principals, changes to the legal entity that operates your business (for example, if you incorporate an entity), or any other pertinent information. We may suspend your account or terminate this Agreement if you fail to keep this information current. In addition, as certain parts of the Eplayment Service may become available or be offered only on a selective or promotional basis, supplementary information may be required from your end in order to enable and avail of it.
3.5. You may upgrade your Eplayment Account into a Verified Account. This will require KYC verification, as a Verified Account. Verified Accounts are linked to a Netbank savings account and shall be governed by the Netbank Account Terms and Conditions (https://www.eplayment.co/legal/netbank-terms-and-conditions) and Privacy Policy (https://www.eplayment.co/legal/netbank-privacy-policy) in addition to the existing Agreement. Insofar as the features and capabilities of the Eplayment Wallet and customer assistance are concerned, these T&Cs shall prevail in case of conflict with the Netbank Account Terms and Conditions.
3.6. Without our express written consent, you may not register or attempt to register for an account on behalf of a user of Eplayment whose account was previously terminated and is otherwise barred from further use of the Eplayment Service.
3.7. Upon registration and verification as an Epaygames Merchant, you will be asked to create or nominate an Eplayment Account. By registering for an account on behalf of an entity, you represent and warrant that you have authority to accept these T&Cs on behalf of and bind the entity, and provide information on behalf of the entity. We may require you to provide additional information or documentation demonstrating such authority to bind the entity.
3.8. In addition to the above, at any time during your use of the Eplayment Service as an Epaygames Merchant, we may require additional information from you to verify beneficial ownership or control of the business, validate information you provided, verify your identity, and assess the risk to Eplayment and the customer associated with your business. This additional information may include phone numbers, physical and mailing addresses for you and your business, your business’s tax identification number, business invoices, copies of government-issued identification, business licenses, or other information related to your business, its beneficial owners, or principals. We may also request that you provide copies of financial statements or records pertaining to your compliance with this agreement or require you to provide a personal or company guarantee. Your failure to provide this material information may result in suspension or termination of your Eplayment account. We may share this information, including any other personally identifiable information you provide to us, with third-party partners we work with to comply with regulations, including anti-money laundering laws. The Eplayment Wallet is a reloadable e-money instrument subject to the rules and regulations of the BSP, the Anti-Money Laundering Act (“AMLA”), as amended and the Data Privacy Act of 2012 (“DPA”) and its Implementing Rules and Regulations (“IRR”). It does not earn interest. You may open an Eplayment Account upon registration to the Eplayment Wallet, and upgrade this account further upon undergoing KYC. Verified Accounts are governed by the Netbank Account Terms and Conditions (https://www.eplayment.co/legal/netbank-terms-and-conditions) and Privacy Policy (https://www.eplayment.co/legal/netbank-privacy-policy) in addition to the existing Agreement. Insofar as the features and capabilities of the Eplayment Wallet and customer assistance are concerned, these T&Cs shall prevail in case of conflict with the Netbank Account Terms and Conditions. We may work with Payment Method Providers, Acquirers, Billers, Load Providers, and other third parties relevant to the overall functionality and performance of the Eplayment Wallet. Your use of a particular Payment Method, Acquirer, Biller, or Load Provider may be subject to separate terms applicable to their services. We reserve the right to add or remove Payment Method Providers, Billers, and Load Providers at any time.
4.1. Types
4.2. Functions
Depending on your type of Eplayment Account, you may access certain functions of the Eplayment Wallet. Some of these functions are available to every user upon registration, whereas other functions may only be accessed after undergoing KYC verification or account upgrade. Eplayment may introduce or deactivate functions at its sole option. In the section above, you may review which functions are available to which account type. Each function is described as follows:
4.3. Transaction and Balance Limits
Transaction and balance limits shall be determined solely by Eplayment, pursuant to applicable laws. Limits are applied based on your account type with the highest level.
4.4. Account Fees
Eplayment charges no annual fee for Verified Accounts.
4.5. Transaction History
Upon the request of the Eplayment Account holder, Eplayment shall send a copy of their Transaction History via email. The mere act of Eplayment in sending the Transaction History to the user is a conclusive presumption that the user has received it. Eplayment shall not be held liable should the Transaction History be read by any person other than the intended user. Neither may the user thereafter raise the defense that they failed to receive the Transaction History statement.
4.6. Disputes on Unauthorized and Erroneous Transactions
The details in the SMS confirmation message after particular transactions including, but not limited to, Cash In, Send Money, Pay Bills, Buy Load, and Buy Game Credits, Buy Lifestyle Pins and the entries in the Transaction History are presumed true and correct unless the user notifies Eplayment in writing of any discrepancy or dispute thereon within fifteen (15) days from the date of transaction. If no such dispute is reported within the said period, all transactions and the entries in the Transaction History are considered conclusively true and correct. Disputed transactions shall only be credited back to the Eplayment Wallet once the dispute has been properly investigated, and ascertained to be in favor of the user, in accordance with the applicable laws, rules and regulations.
For unauthorized transactions, the user must immediately report the same within fifteen (15) days, otherwise the same will no longer be acted upon. Eplayment limits its liability to unauthorized transactions which occurs when your account has been accessed by other person/s without your fault or negligence, or when your Eplayment Account has been compromised due to any gaps in the system which led to disclosure of your confidential information. In particular, Eplayment shall not be liable to any unauthorized transactions arising from:
In case of erroneous transactions, or payments sent to a wrong party while using the Pay Bills, Buy Load and Fund transfer functions of the Eplayment Wallet, Eplayment shall exert reasonable effort to resolve the issue, provided that the same is reported within the period provided above. The transactions shall be deemed successful and shall follow a no refund policy if the erroneous transaction, after investigation, has been proven to be due to the user’s own fault or negligence (e.g. erroneous input of account details, Biller, Load Provider and Payment Method), and after determination that the amount is no longer recoverable despite employment of reasonable effort. The decision of Eplayment after such investigation shall be conclusive.
Epaygames Payment Gateway is Eplayment’s payment software and gateway API offered to businesses in Gaming and Entertainment. Epaygames Merchants may use the Epaygames Payment Gateway within their website or application to collect payments from their customers via our available Payment Methods. We also use this technology to process Add Funds transactions in the Eplayment Wallet. The Epaygames Payment Gateway is subject to the rules and regulations of the BSP, the AMLA, as amended and the DPA and its IRR. We may work with Payment Method Providers, Acquirers, and other third parties relevant to the overall functionality and performance of the Epaygames Payment Gateway. Your use of a particular Payment Method or Acquirer may be subject to separate terms applicable to their services. We reserve the right to add or remove Payment Method Providers at any time. You must use the Epaygames Payment Gateway in a lawful manner, and must obey all laws, rules, and regulations applicable to your use.
5.1. API Integration
Epaygames Merchants may use the Epaygames Payment Gateway APIs solely asdescribed in the API documentation or as otherwise communicated to you by us. We may update the APIs and API documentation from time to time, and may add or remove functionality. To the extent possible, we will communicate to you any changes in functionality. More details on proper usage are provided in the API documentation.
We grant Epaygames Merchants a revocable, non-exclusive, and non-transferable limited license to access and/or use Eplayment’s APIs, developer’s toolkit, and other software in accordance with the accompanying API documentation made available by Eplayment for purposes of using the Epaygames Payment Gateway. This license grant includes all updates, upgrades, new versions and replacement software for your use in connection with the Epaygames Payment Gateway. If you do not comply with these T&Cs, the API documentation, and any other requirements provided by Eplayment, then you will be liable for all resulting damages suffered by you, Eplayment and third parties. Upon expiration or termination of this Agreement, you will immediately cease all use of the Eplayment Service, including the API and the Epaygames Payment Gateway.
5.2. Settlements
Eplayment will remit to the Epaygames Merchant’s Eplayment Account all amounts due to you from your transactions, minus any fees, fines, reversals, chargebacks, refunds, setoffs, recoupments, or other amounts that you owe to Eplayment under this Agreement and your own contract with Eplayment. You are responsible for and agree to pay any penalties or fines imposed on you in relation to your account by Eplayment, a Payment Method Provider, or Acquirer resulting from your use of Epaygames Payment Gateway in a manner not permitted by this Agreement or the relevant third party’s terms. You affirm that you are authorized to initiate settlements to and debits from your Eplayment Account, and that it is owned by you. If you update your Eplayment Account, then you must ensure that you continue to comply with the requirements of this section.
Settlements to Epaygames Merchants cover 24 hours and are sent out in two to three days. Please be aware that a Payment Method Provider or Acquirer may delay settlement for any reason, and we are not responsible for any harm suffered by you stemming from such delay. Additionally, we reserve the right to suspend settlement to you. Suspension of settlement may occur when there are pending, anticipated, or excessive chargebacks, refunds, or reversals, when we suspect or become aware of suspicious activity, and when we are required by applicable law or court order. We have the right to withhold settlement to your Eplayment Account upon termination of this agreement if we reasonably determine that we may incur losses resulting from credit, fraud, or other legal risks associated with your Account. If we exercise our right to withhold settlement for any reason, we will communicate the general reason and give you a timeline for releasing the funds.
5.3. Legitimate Transactions
To enable us to process transactions for you, you authorize and direct us, our affiliates, the Payment Method Providers and Acquirers to receive and settle any amounts due to you from your transactions through the Epaygames Payment Gateway. You may not grant or assign any interest in the amounts due to you from your transactions to any third party until such time as such amounts are deposited into your Eplayment account. You appoint Eplayment as your agent for the limited purpose of directing, receiving, holding and settling such amounts. You agree that Eplayment’s receipt of such amounts satisfies the relevant end-customer’s obligations to make payments to you.
You may only use our Epaygames Payment Gateway to conduct legitimate transactions with your customers. You are solely responsible for your relationship with your customers. We are not responsible for the products or services you publicize or sell, or that your customers purchase using the Epaygames Payment Gateway. If you accept donations, we are not responsible for your communication to your customers of the intended use of such donations. You understand and affirm that you are solely responsible for the nature and quality of the products or services you provide, and for delivery, support, refunds, returns, and for any other ancillary services you provide to your customers.
You are solely responsible for knowing whether a transaction initiated by your customer is erroneous (e.g. a customer purchasing an item when they meant to purchase another) or suspicious (e.g. unusual or large purchases, such as a request for delivery to a foreign country where this typically does not occur). If you are unsure if a transaction is erroneous or suspicious, you agree to conduct relevant research on the transaction and, if necessary, contact your customer before fulfilling or completing the transaction. You are solely responsible for any losses you incur due to erroneous or fraudulent transactions in connection with your use of the Eplayment Service.
Transactions facilitated through the Epaygames Payment Gateway shall only be reported by Eplayment with the Anti-Money Laundering Council (AMLC), when so directed in accordance with its rules and regulation. Complementary to this, Eplayment shall likewise observe the provisions of Section 12.2 of these T&Cs when dealing with Fraudulent Transactions, if warranted.
5.4. Your Customers
Except where Eplayment and a customer have otherwise agreed, you maintain the direct relationship with your customers and are responsible for acquiring appropriate consent to transact through the Epaygames Payment Gateway on their behalf, providing confirmation or receipts to customers for each transaction, verifying customers’ identities, and determining a customer’s eligibility and authority to complete transactions.
5.5. Chargebacks
You understand and agree that authorized transactions may still be subject to a chargeback. We are not responsible for or liable to you for authorized and completed transactions that are later the subject of a chargeback, refund, or reversal, are submitted without authorization or in error, or violate any applicable laws or regulations. Epaygames Merchants are immediately responsible to us for all chargebacks, refunds, reversals, or fines, regardless of the reason or time.
Eplayment shall refer to the Epaygames Merchant all transactions disputed by the customer and Epaygames Merchant undertakes to resolve the dispute with the customer within fifteen (15) business days upon receipt of advice from Eplayment. Disputed transaction/s which the Epaygames Merchant has failed to resolve within the aforestated period shall be automatically charged back by Eplayment from the Epaygames Merchant.
The amount corresponding to the chargeback shall first be applied by Eplayment against the future billings of the Epaygames Merchant. If no sum or payment is due to the Epaygames Merchant that will allow Eplayment to deduct/set-off the chargeback amount, Eplayment shall seek reimbursement from the Epaygames Merchant of the chargeback amount, upon which the Epaygames Merchant shall reimburse Eplayment within three (3) banking days from receipt of written demand. If despite receipt of such demand, the Epaygames Merchant fails to reimburse Eplayment, the Epaygames Merchant hereby expressly authorizes Eplayment to deduct the chargeback amount due without the need of demand or of any further act or deed, against any money, securities and things of value which are now or may hereinafter be in the possession of Eplayment or any of its subsidiaries and affiliates.
You may be able to challenge a chargeback by submitting evidence to us by sending an email to Eplayment Help & Support (support@eplayment.co). We may request additional information to provide to Payment Method Providers and Acquirers to assist you in contesting the chargeback, but we cannot guarantee that your challenge will be successful. Payment Method Providers and Acquirers may deny your challenge for any reason they deem appropriate. You may not submit a new charge which duplicates a transaction that is subject to a chargeback.
5.6. Applicable Taxes
Such taxes, fees, and duties paid by you shall not be considered a part of, a deduction from, or an offset against, payments due to Eplayment hereunder. Additionally, you understand that we may send documents to you and tax authorities for transactions processed using the Epaygames Payment Gateway. Pursuant to applicable law, we may be required to file periodic informational returns with taxing authorities in relation to your use of the Eplayment Service.
We maintain our Eplayment Website to inform you about the Eplayment Service, and to facilitate communication between Eplayment and its stakeholders. We require that all the visitors to our website adhere to these rules and regulations. By accessing the Eplayment Website, you indicate your acknowledgment and acceptance of these terms and conditions even as they are modified and posted accordingly.
6.1. Eplayment owns and holds all relevant licenses for all text and images appearing at the Eplayment Website, or others as indicated. The information and materials contained in the website may not be copied, displayed, distributed, downloaded, licensed, modified, published, reposted, reproduced, reused, sold, transmitted, used to create a derivative work or otherwise used for public or commercial purposes without the express written permission of Eplayment.
6.2. Not all of the products or services described on the Eplayment Website are available in all geographic areas, such as the Eplayment Wallet, PIXEL by Eplayment and Epaygames. You may not be eligible for all the products or services described. Eplayment reserves the right to determine the eligibility for any product or service.
6.3. Any communication or material you transmit to us via the Eplayment Website or Internet electronic mail is on a non-confidential basis and may be used by Eplayment for any purpose within the limits of our privacy statement including reproduction, publication broadcast and posting.
6.4. We will use our best efforts to include accurate and up to date information on the Eplayment Website, but we make no warranties or representations as to the accuracy of the information. You agree that all access and use of the website and its contents is at your own risk. By using the website, you acknowledge that we specifically disclaim any liability (whether based in contract, tort, strict liability or otherwise) for any direct, indirect, incidental, consequential, or special damages arising out of or in any way connected with your access to or use of the website, (even if we have been advised of the possibility of such damages) including liability associated with any viruses which may infect a user's computer equipment.
6.5. You agree that your use of the Eplayment Website shall be governed by all applicable Philippine laws. Venue of all suits shall be exclusively at the appropriate courts of Quezon City or at any location at the exclusive option of Eplayment.
Eplayment has recently launched “Eplayment Tokens” as part of its loyalty program where verified users can collect and earn Tokens by performing various activities and transactions using the Eplayment app. This may include the creation and setting app of the Eplayment account, cash in of funds to Eplayment wallet, sending money to other users, purchase of gaming, lifestyle pins and prepaid loads, bills payment and usage of the app’s other special functions such as email linking, QR generation and usage, and more. The amount of Tokens collected has a conversion value that can be used to claim and redeem Eplayment offers ranging from gaming and lifestyle pins and other rewards.
The Eplayment Customer’s rights and obligations in the said loyalty program shall be covered by a separate terms and conditions.
You agree to pay all fees, rates, and other charges applied by Acquirers and regulated third-party fund transfer services when transacting with your Eplayment Account. These charges may apply to transactions such as, but are not limited to, Cash In, pay bills, buy load, Fund Transfer, Cash Out, Buy Gaming Pins and Lifestyle Pins. Fund Transfer fees may vary depending on the pricing strategy of each participating institution, the summary of which may be found in the BSP website (bsp.gov.ph/PaymentAndSettlement/Fees.pdf). You accept that Eplayment, Acquirers, and participating institutions may revise the fees at any time. When making transactions within the Eplayment Wallet interface, fees and other charges are reflected and advised to the user upon checkout. Fees and other charges, as may be applicable, shall be inclusive of all applicable Philippine taxes and shall be debited from your Eplayment Account or paid upfront.
In the case of payments from customers to the Epaygames Merchant, we charge a service fee to the Epaygames Merchant based on the pricing strategy of our Payment Method Providers and Acquirers. Fees and other charges, as may be applicable, shall be inclusive of all applicable Philippine taxes and shall be deducted from the settlement, debited from your Eplayment Account, or paid upfront.
You shall be responsible for the security and proper care of your device, Eplayment Account, and all associated login and payment credentials including your MIN, MPIN, and passwords. All transactions made using your Eplayment Account and are conclusively presumed to be made by you. You are solely liable for all losses incurred when your lost or stolen payment credentials or accounts are used to purchase products or services. Eplayment cannot and will not insure you against losses caused by fraud under any circumstances.
In case of loss of your Eplayment Account, you shall immediately report to Eplayment Help & Support of such loss within twenty-four (24) hours, via phone call or written report/affidavit scanned and sent through email or submitted to the Eplayment office. Suspension of your Eplayment Account shall be processed only upon proper authentication of the report, as the case may be. All transactions made prior to the report of loss shall continue to be your sole liability. A replacement account, MIN, may also be created at cost to you.
At any time, you may discontinue your use of the Eplayment Service through voluntary termination. Please read our Privacy Notice to understand how we handle your information accordingly. Termination does not immediately relieve you of obligations incurred by you under this agreement. Upon request of termination, you agree to complete all pending transactions and stop accepting new transactions. Your continued or renewed use of the Eplayment Service after all pending transactions have been processed serves to renew your consent to these T&Cs. If you terminate this agreement, we will pay out any remaining funds owed to you subject to these T&Cs. Eplayment may suspend or terminate an Eplayment Account and that user’s privilege to use any part of the Eplayment Service, whenever it deems necessary, without prior notice or obligation to disclose the reasons for such closure, particularly, but not limited to suspected cases of fraudulent, criminal, or unlawful activities. In case of reactivation, as requested by the user, a reactivation charge may apply. The approval of any reactivation request remains the sole option of Eplayment.
After termination by either party, you shall no longer have access to and shall cease all use of the Eplayment Service. Any termination of this agreement does not relieve you of any obligations to pay any financial obligation incurred by you or through your use of the Eplayment Service before or after termination. In addition, all licenses granted to you by Eplayment under this agreement shall be terminated. In the case of Epaygames Merchants, you must immediately remove all trademarks from your website or application, unless permitted under a separate license with the service provider.
Should you fail to comply with the Terms and Conditions provided herein, the right to use the Eplayment Wallet, PIXEL by Eplayment and/or Epaygames Payment Gateway shall be terminated.
Eplayment makes no warranty, express or implied, regarding the Eplayment Service. The Eplayment Service is offered on an “AS IS, AS AVAILABLE” basis without warranties of any kind, other than warranties that are incapable of exclusion, waiver, or limitation under the laws applicable to this agreement.
In the event of any action filed against Eplayment, the Eplayment user agrees that Eplayment’s liability shall not exceed ONE THOUSAND PESOS (PHP 1,000.00), or the amount of the damages actually suffered by the Eplayment Customer, whichever is lower.
Eplayment shall have the right to automatically suspend or block the Eplayment Account in the event that we have reason to believe that it may be used for fraudulent or suspicious transactions or by an unauthorized person. Eplayment may, but shall not have the obligation to, inform you prior to suspending or blocking your Eplayment Account and Pixel by Eplayment pursuant to this section. You shall hold Eplayment free and harmless against any and all consequences of such suspension or blocking, or any loss or damage suffered as a result thereof.

12.2. Fraudulent Transactions via Epaygames Payment Gateway
Each party undertakes to provide complete support and assistance to the other party in detecting, investigating, and preventing any offense that may be committed, or has been committed under this agreement, by any person against Eplayment or the Epaygames Merchant. Should any prohibited practices or restricted service, fraudulent transactions, counterfeit cards, chargebacks, violation of any BSP rules and regulations, and/or similar incidents be performed by the Epaygames Merchant or third party (Suspected Activity), the incident may be the subject of an investigation, at the option of Eplayment.
Our Privacy Notice (https://www.eplayment.co/legal/privacy-notice) describes how we handle the information you provide to us when you use the Eplayment Service. Any case or dispute arising from these terms and conditions shall be governed and litigated under the laws of the Republic of the Philippines. Venue of all suits shall be exclusively at the appropriate courts of Quezon City or at any location at the exclusive option of Eplayment.
Failure, omission, or delay on the part of Eplayment to exercise its rights or remedies under these Terms and Conditions shall not operate as a waiver.
Should any term or condition in this Agreement be rendered void, illegal, or unenforceable in any respect under any law, the validity, legality, and enforceability of the remaining terms and conditions shall not be affected or impaired thereby.
You agree to be bound by the T&Cs governing the issuance and use of the Eplayment Service upon your download, activation, or use of the Eplayment Service. Should you disagree with the T&Cs, you shall and call or provide a written notice of cancellation of your Eplayment Account to Eplayment Help & Support. Otherwise, you shall continue to be liable for all charges incurred through the use of the Eplayment Wallet.
You will be promptly notified of any material or substantial changes or amendment in the T&Cs within sixty (60) days prior to such amendments by such means of publication or communication determined by Eplayment, unless the amendments are directed by the BSP to take effect immediately or unless otherwise provided by existing laws, rules and regulations.
There is “substantial” or “material” change when there is significant modification in the use, features, or rate of the fees and charges of the Eplayment Services, as mandated by pertinent laws and rules and regulations. You are considered to have agreed to be bound by the modifications by continuing to access and use Eplayment Service after any such modifications. You have the right to terminate your registration if after due notice, you wish not to be bound by the amended T&Cs.
Consent given by the Eplayment Wallet and PIXEL holder to an affiliate for any of its services or products involving use, processing, and/or disclosure of their Eplayment Account information shall be deemed to be consent given to Eplayment.
